General Terms and Conditions (GTC)
Effective Date: April 28, 2025
1. Scope of Application
These General Terms and Conditions apply to all purchase contracts concluded between you and Gheymati GmbH, Kleine Stadtgutgasse 6–8, 1020 Vienna, Austria (hereinafter referred to as "Gheymati") via the webshop at https://gheymati.myshopify.com/.
2. General Information, Ordering Process, and Contract Conclusion
Gheymati sells products offered in its webshop exclusively in customary household quantities to consumers aged 18 years and older (legal age of majority).
The exclusive language of contract, ordering, and communication is German.
You may collect the products offered by clicking the “Add to Cart” button on the respective product detail pages.
After completing your product selection, you may proceed to checkout via the cart by clicking the "Checkout" button, where you will enter your personal details, select delivery and payment options.
Alternatively, you can initiate checkout directly from a product page using the “Buy Now” button.
In either case, you will then be prompted to enter your email address, delivery address, and payment details.
After clicking "Review Order," a summary of your provided data (email, delivery address, shipping method including costs, and payment method) as well as the selected products will be displayed.
Prior to clicking "Buy Now," you can amend or correct your order and input data at any time.
Only upon clicking "Buy Now" do you submit a binding offer to enter into a purchase contract with Gheymati.
The purchase contract is only concluded when Gheymati explicitly accepts your offer or dispatches the ordered goods – whichever occurs first, and no later than 6 business days (business days = Monday to Saturday) after your order is placed.
The mere confirmation of receipt of your order sent via email does not constitute acceptance of the offer but solely confirms receipt of your request.
If you did not print or save your order details and these GTC during the checkout process, we recommend saving the order confirmation email, as Gheymati does not store the contract data.
3. Payment Terms
Payment can be made using the following methods:
Austria:

Payments are processed via Shopify Payments, a service provided by Shopify International Ltd., c/o Intertrust Ireland, 2nd Floor, 1–2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland. (See: https://www.shopify.com/)
Redeeming discount codes:
Discount codes can be entered during checkout in the designated field. After entering the code, click “Apply” – the discount will automatically be deducted from your total.
4. Delivery Terms
Deliveries are made exclusively to Austria and Germany.
Unless otherwise stated on the product detail page, delivery will occur no later than 30 days after the conclusion of the contract (see Section 2).
The risk of loss or damage to the goods does not transfer to you until the goods have been delivered to you or to a third party designated by you who is not the carrier.
5. Warranty
Statutory warranty rights apply.
6. Right of Withdrawal (Cancellation Policy)
You have the right to withdraw from the purchase contract within 14 days without stating any reason.
The withdrawal period is 14 days from the day you or a third party designated by you (other than the carrier) took possession of the goods.
To exercise your right of withdrawal, you must notify Gheymati GmbH (address: Kleine Stadtgutgasse 6–8, 1020 Vienna, Austria; phone: +43 1 934 6444; email: office@gheymati.com) by means of a clear declaration (e.g., by letter or email) of your decision to withdraw. You may use the withdrawal form template provided below, though it is not mandatory.
Timely dispatch of the notice before the deadline is sufficient to meet the withdrawal deadline.
7. Consequences of Withdrawal
If you withdraw from this contract, Gheymati shall refund all payments received from you, including standard delivery costs (excluding additional costs for alternative shipping methods), without undue delay and no later than 14 days from receipt of your withdrawal notice.
Refunds will be made using the same payment method you originally used, unless expressly agreed otherwise. No fees will be charged for the refund.
Gheymati may withhold the refund until the goods are returned or you provide proof of return, whichever occurs first.
You must return the goods to Gheymati GmbH, Kleine Stadtgutgasse 6–8, 1020 Vienna, Austria, without undue delay and no later than 14 days from the date you informed us of your withdrawal. The deadline is met if the goods are dispatched before the end of the 14-day period.
You bear the direct cost of returning the goods. You are only liable for any loss in value if this loss is due to handling that was not necessary to check the condition, characteristics, and functionality of the goods.

9. Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery.
10. Retention of Title
The goods remain the property of Gheymati until full payment of the purchase price has been received.
11. Governing Law
The contract between you and Gheymati is governed by Austrian law, excluding its conflict-of-law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).
This choice of law does not deprive you of mandatory consumer protection rights applicable in the country of your habitual residence.
12. Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr, which will be discontinued as of July 20, 2025.
Gheymati does not participate in out-of-court dispute resolution procedures before a consumer arbitration board.
